In Plain English: We provide tools to help you land interviews. You promise to use them responsibly and not spam people. We promise to do our best to keep the service running smoothly.

1. Acceptance of Terms

By creating an account, you agree to:

If you don't agree, please don't use SmartReached.

2. Eligibility

To use SmartReached, you must:

  • Be at least 16 years old
  • Have the legal capacity to enter into contracts
  • Not be prohibited from using the service under applicable laws
  • Provide accurate information during signup

3. Account Security

Your Responsibilities

  • Keep your password secure (use a password manager!)
  • Don't share your account with others
  • Notify us immediately if your account is compromised: hello@smartreached.com

Gmail OAuth Access

When you sign in with Google, you grant SmartReached permission to:

  • Send emails from your Gmail account
  • Read email threads (to detect replies)

Important: We ONLY send emails when you explicitly click "Send." We never send emails without your knowledge.

4. Subscription Plans & Billing

Plans

  • Free: 5 total credits (one-time)
  • Pro: $19/month, $39/quarter, $99/year (150 credits/month)
  • Pro Plus: $39/month, $99/quarter, $249/year (500 credits/month)

Billing Cycle

  • Monthly: Billed on the same day each month
  • Quarterly: Billed every 3 months
  • Annual: Billed once per year

Refunds

  • Free Trial: No refunds (it's free!)
  • Paid Plans: Refunds issued within 7 days of initial subscription only
  • Mid-Cycle Cancellations: No prorated refunds. Access continues until end of billing period.

5. Acceptable Use Policy

You agree NOT to use SmartReached to:

  • ❌ Send spam or unsolicited bulk emails
  • ❌ Violate CAN-SPAM Act, GDPR, or other anti-spam laws
  • ❌ Impersonate others or provide false information
  • ❌ Harass, threaten, or abuse recipients
  • ❌ Scrape or export data for use outside SmartReached
  • ❌ Reverse engineer, decompile, or hack the service
  • ❌ Use for illegal purposes (phishing, fraud, etc.)

Email Best Practices

  • ✅ Only contact people you have a legitimate reason to reach
  • ✅ Include accurate sender information (your real name)
  • ✅ Honor unsubscribe requests immediately
  • ✅ Verify email addresses before sending

6. Intellectual Property

Our IP

SmartReached owns all rights to the platform, code, design, brand name, logo, trademarks, and AI models.

Your Content

You retain ownership of your resume, emails, and contact lists. We do NOT claim ownership of your content.

AI-Generated Content

Emails generated by our AI are yours to use. However, you're responsible for reviewing and editing before sending.

7. Disclaimer of Warranties

SmartReached is provided "AS IS" without warranties of any kind. We do NOT guarantee:

  • ❌ That emails will get replies (we can't control recipient behavior)
  • ❌ That AI-generated emails are perfect (always review before sending!)
  • ❌ That the service will be error-free or uninterrupted
  • ❌ That using SmartReached will get you a job

Your Use is at Your Own Risk: We're not responsible if you send an email with a typo or wrong company name. Always proofread!

8. Limitation of Liability

To the maximum extent permitted by law, we are NOT liable for:

  • Lost profits, data, or opportunities
  • Indirect, incidental, or consequential damages
  • Damages exceeding the amount you paid us in the past 12 months

9. Termination

By You

You can delete your account anytime in Settings. We'll delete your data within 30 days.

By Us

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, use the service for illegal purposes, or fail to pay.

10. Changes to Terms

We may update these Terms. When we do:

  • Post the new version at smartreached.com/terms
  • Update the "Last Updated" date
  • Notify you via email for material changes
  • Continued use = acceptance of new Terms

11. Governing Law

These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.
